1. LIMITED HARDWARE WARRANTY POLICY
The following is our policy to a warranty holder with a valid Limited Hardware Warranty ("You") for a Zii-branded product and/or a Zii-branded accessory (both referred to as "Product" in this policy) originally purchased online at a Zii web site or from an authorized retailer/reseller. For the avoidance of doubt, this policy is not the Limited Hardware Warranty document and does not constitute Zii Pte. Ltd. as an additional party with warranty obligations under the Limited Hardware Warranty if another legal entity is specified therein as the party with the warranty obligations. Please note that not all Product models have warranty coverage. In addition, not all Limited Hardware Warranties allow assignment to subsequent users.
A Limited Hardware Warranty generally provides a warranty that the Product is free from material defects in materials and workmanship that cause product failure during Your fair and reasonable usage of the Product for the warranty period.
Generally, a Limited Hardware Warranty does not apply to product failure due to, but not limited to, the following reasons:
- Improper installation or handling or non-compliance with instruction manual or other warranty provider instructions.
- Accident, abuse, misuse, neglect, normal wear and tear, corrosion, physical damage, rusting and staining, and all other forms of improper usage.
- Damage from external causes and natural disaster, such as flood, storm, fire, sand, dirt, earthquake, an Act of God, exposure to sunlight, weather effect, lightning, moisture, water, liquid, heat, vibration, corrosive environment, electrical surge, battery leakage, theft or damage caused by the connection to other products not recommended for interconnection.
- Any Product that has had its serial number altered, defaced or removed.
- Insufficient or excessive electrical supply.
- Abnormal mechanical or environmental conditions.
- Unauthorized disassembly, alterations, repairs or modifications.
- Damage to the Product or it being rendered ineffective due to putting in, using, or attempting to put in or use, products/modules/parts/components that are: (i) not designed to specifications provided in the user guide or at our web site, (ii) incompatible with the Product, and/or (iii) counterfeit products/modules/parts/components. Whether a product/module/part/component is incompatible or a counterfeit shall be at our sole determination.
- Installation of any incompatible third party application or any corrupted application or content that affects the Product’s software or firmware.
- Damage or loss of data due to (i) interoperability with current and/or future versions of operating systems or other current and/or future software and hardware, (ii) a computer virus, worm, Trojan horse or memory content corruption, or (iii) malfunction of or defect in the Product.
- In the case of communications products, the use of the Product outside the borders of the country that it is intended for (as indicated by any local telecommunication approval stickers).
We and the provider of the Limited Hardware Warranty shall not be liable for:
- Loss of data during the use or attempted use of the Product or any of our or our affiliated companies’ service(s). Data retrieval or recovery is not covered under this warranty, and is not part of the warranty repair or exchange process.
- Damage to other products, including but not limited to personal computers, used with the Product.
- Third party charges and costs incurred by You for troubleshooting, removing, servicing, repairing or installing any Product(s) or Software or third party-branded products or software.
- Damage resulting from a third party-branded product or software that causes the Product to fail.
- Any consequential, indirect or incidental damages, lost profits, lost savings, loss of business investments, loss of goodwill, or interference with business relationships as a result of lost data and from the usage of the Product or any of our or our affiliated companies’ service(s).
- Any period of time the Product is at the service center or in transit. Your citing this period of time in an attempt to extend the warranty period shall have no effect.
- Any non-Zii-branded goods, including those purchased at our Site(s). Under this policy, third party-branded products or accessories will not be serviced by us or the service center under any circumstances. Warranty servicing is not provided for any software (including Zii-branded Software) or third party applications, nor will Your Product be serviced where software or third party applications may have contributed to the cause of hardware operating failure.
The Limited Hardware Warranty may give You specific legal rights. You may also have other rights, which vary from state to state and country to country. The terms of the Limited Hardware Warranty generally do not exclude such rights. Some states and countries disallow limitations on how long an implied warranty lasts, or the exclusion or limitation of incidental or consequential damages or the exclusion of liability for injury (including death) caused by negligence, so the above limitations or exclusions may not apply to You depending on the relevant jurisdiction.
Please refer to any Limited Hardware Warranty or other warranty documentation accompanying Your Product for more specific terms and conditions.
In the event of any conflict with the terms of this policy, the terms of the Limited Hardware Warranty or other warranty document accompanying Your Product shall govern.
In the event that you cannot find the Limited Hardware Warranty with Your Product, check with Zii Contact Center to see if a Limited Hardware Warranty was issued with Your Product, whether Your Product is still under warranty or whether a replacement copy of the Limited Hardware Warranty can be obtained. For a third party-branded product, You should check with the manufacturer, their web site or their authorized agent for a copy of the warranty document.
A returned Product that is not covered by a valid Limited Hardware Warranty will be subject to a servicing fee and other charges if Out-of-Warranty support is available. In the event of your failure to pay, the service center may decline to service or return the Product. Please refer to our Warranty Return Policy for more information.
2. WARRANTY PERIOD
The warranty holder is generally accorded a specific and pre-determined warranty period for the Product. Please refer to the Limited Hardware Warranty document that accompanies the Product and to Schedule 1 of this policy for the original warranty period. Please also refer to the Product information web page at zii.com. The original warranty period (if any) commences from the date of delivery at the address designated by the original purchaser of the Product sold by Zii Pte. Ltd., its affiliated companies, or from the date of original purchase from the authorized retailer/reseller.
Unless indicated otherwise in the Limited Hardware Warranty accompanying the Product or on zii.com, the serviced Product will (i) be covered for the remaining warranty period OR (ii) a one-off warranty for a specific and pre-determined period from dispatch date from the service center, whichever gives You longer warranty coverage. Please refer to Schedule 1 herein for serviced Product one-off warranty period (if any). However, if You make a subsequent warranty return, You will not be given a further warranty period or extension.
The service center may require a copy of the invoice as proof of original purchase prior to any warranty servicing. If You are unable to provide this when requested, the warranty return will be deemed Warranty-Expired and a Warranty-Expired servicing fee shall apply.
3. TYPES OF WARRANTY RETURNS
There are generally four (4) types of warranty returns. The details of the different types of warranty returns are classified below for reference. Please note that the appropriate classification for each type of warranty return will be determined solely by the warranty provider. The availability of the types of warranty return support depends on the Product model. Please refer to Schedule 2 for the types of warranty return support for various Products.
DOA (Dead-on-Arrival) Return applies when a newly-purchased Product is found to be defective within the first seven (7) calendar days of date of delivery. Examples of defective Products include:
(a) It will not power-up,
(b) Basic functions will not operate,
(c) It is damaged during shipment or transit to You.
If You report the defective Product after seven (7) calendar days of the date of receipt at the designated address, the service center will process the defective Product as an RMA Return.
RMA (Return Merchandise Authorization) Return (i.e. for Product that is under valid warranty) applies when the Product is found to be defective after seven (7) calendar days of the date of receipt of the newly-purchased Product until the end of the warranty period. This is also applicable if You receive any additional service of the Product from the service center after the return of the serviced Product.
Warranty-Void Return applies when the Product is returned within the warranty period, with user-induced damage, including but not limited to physical damage such as cracked screen or cracked casing, unauthorized modifications, damage due to liquid and/or heat, abuse, wear and tear, any other damage not considered a manufacturing defect as set forth in Section 1 herein. User-induced damage will render the Product Out-of-Warranty. There are different Warranty-Void servicing fees depending on the Product model. WARRANTY-VOID SERVICING FOR ACCESSORIES IS NOT AVAILABLE.
Warranty-Expired Return applies when the Product is returned after the valid warranty has expired, rendering it Out-of-Warranty. There are different Warranty-Expired servicing fees depending on the Product model. WARRANTY-EXPIRED SERVICING FOR ACCESSORIES IS NOT AVAILABLE.
4. WARRANTY SUPPORT
Prior to any warranty return, You are strongly encouraged to check the Zii Support Web Page for information regarding warranty and returns and other frequently asked questions. You should confirm that your Product qualifies under our warranty and returns coverage prior to applying for a Product return.
5. DATA, CONTENT AND APPLICATION BACK UP
Prior to any warranty return, You are encouraged to back up all important information stored in the Product, including but not limited to data, content and applications, as servicing the Product may wipe out Your information. The service center does not back up Your information nor perform any data retrieval or recovery. Please be reminded a back up is only as useful as its associated restore strategy.
6. SERVICING OF PRODUCT
The service center may at its sole discretion perform one of the following for any Product sent for servicing:
(a) Service or repair the Product.
(b) Replace Product with a new or refurbished product of the same model.
(c) Replace Product with a new or refurbished product model of equivalent value (subject to depreciation and other considerations).
Where the Product is under a valid warranty, You will not have to pay any labor charge. You will also not have to pay for replacement parts.
Where the Product is not under a valid warranty, there are service charges (e.g. see Section 9 Out-of-Warranty charges) and charges for replacement parts. However, certain Products are not provided with any Out-of-Warranty support.

7. COST OF SHIPPING/TRANSPORT
You shall bear the cost of shipping/transporting (including any duties and taxes) the Product to the service center for DOA, RMA (Product under valid warranty), Warranty-Void and Warranty-Expired cases.
The warranty provider shall bear the cost of shipping/transporting (including any duties and taxes) the serviced or replacement Product from the service center to You for DOA, RMA (Product under valid warranty), Warranty-Void and Warranty-Expired cases.

8. PRODUCT MODEL TRANSITION
When a Product model has reached its End of Service Life, warranty coverage will automatically cease regardless of the warranty period remaining. Any warranty return for Product models that have reached End of Service Life will not be serviced, but may be replaced with a more recent product model of the equivalent-price range as solely determined by the warranty provider.
9. OUT-OF-WARRANTY CHARGES
There are charges for servicing, repairing and replacing parts of Warranty-Void and Warranty-Expired Products. These charges are subject to change from time to time and may vary based on different countries and/or regions. Please note that certain Products are not provided with any Out-of-Warranty support.
10. NO TRADE-IN FOR OUT-OF-WARRANTY PRODUCTS
Unless otherwise stated in writing by the warranty provider, any trade-in for Out-of-Warranty Products (including Warranty-Void or Warranty-Expired Products) will not be accepted, even if You offer to pay the difference between the servicing fee and the retail price of a new product.
11. PRODUCT PROVIDED ‘'AS IS'’. INSOFAR AS PERMITTED BY APPLICABLE LAW, THE PRODUCT(S) AND/OR SERVICED PRODUCT(S) ARE PROVIDED "AS IS". TO THE EXTENT PERMITTED BY APPLICABLE LAW, WE AND THE WARRANTY PROVIDER HEREBY DISCLAIM THE APPLICABILITY OF ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR USE FOR THE PRODUCT(S) AND/OR SERVICED PRODUCT(S).
12. LIMITATION OF LIABILITY. Limitation of liability under this policy and/or the Limited Hardware Warranty, if any, is the original purchase price of the Product (excluding any tax, shipping and additional charges) at the time of purchase from us or the authorized retailer/reseller. Liability for any other losses or damages shall not apply. This remedy is Your exclusive remedy in the event of breach of warranty by us and/or any of our affiliated companies. Any action or lawsuit for breach of warranty must commence within eighteen (18) months following the date of original purchase of the Product from us, our affiliated company or the authorized retailer/reseller. Some states and countries do not allow limitations on how long an implied warranty lasts, or the exclusion or limitation of incidental or consequential damages or the exclusion of liability for injury (including death) caused by negligence, so the above limitations or exclusions may not apply to You depending on the relevant jurisdiction.
13. EXCLUSION OF LIABILITY. WE AND OUR AFFILIATED COMPANIES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO ANY LOSS OF PROFITS OR POTENTIAL PROFITS, LOSS OF SAVINGS OR ANTICIPATED SAVINGS, LOSS OF BUSINESS OR GOODWILL, LOSS OF DATA, LOSS OF OPPORTUNITIES, OR LOSS OF USE OF THE PRODUCT OR ANY EQUIPMENT, COST OF CAPITAL, COST OF SUBSTITUTE OR REPLACEMENT PRODUCT, EQUIPMENT, FACILITIES OR SERVICES, DOWN TIME, YOUR TIME, REGARDLESS OF THE FORM OF ACTION, ANY THIRD PARTY CLAIMS, AND ANY INJURY TO PROPERTY OR BODILY INJURY (INCLUDING DEATH) TO ANY PERSON, ARISING FROM OR RELATING TO THE USE OF OR THE INABILITY TO USE THE PRODUCT OR ARISING FROM BREACH OF THE WARRANTY, BREACH OF CONTRACT, NEGLIGENCE, TORT, OR STRICT LIABILITY, WHETHER OR NOT SUCH LOSS OR DAMAGE WAS FORESEEABLE, EVEN IF WE OR ANY OF OUR AFFILIATED COMPANIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
14. STATUTORY RIGHTS UNAFFECTED
Your Limited Hardware Warranty gives You specific legal rights. You may also have other rights, which may vary from state to state and country to country. The terms of the Limited Hardware Warranty do not exclude such rights or limit them. Your statutory rights are unaffected. Some states and countries do not allow (i) exclusions of, or limitations on, certain liabilities or warranties, including but not limited to how long a warranty lasts, the exclusion or limitation of incidental or consequential damages, or the exclusion of liability for injury (including death) caused by negligence, (ii) the inclusions of certain asymmetrical terms in warranties, or (iii) the expiration of all legal claims after a fixed time, so certain of the above limitations, exclusions or asymmetrical terms may not apply to You depending on the relevant jurisdiction. If adjudged invalid, such term(s) would be severable without affecting the validity of the other terms.
15. REFER TO LIMITED HARDWARE WARRANTY ACCOMPANYING PRODUCT; REFER TO WARRANTY RETURN POLICY AT THE SITE
The terms herein are a general statement of our policy on product warranty for preview prior to Your purchase of a Product from us, any of our affiliated companies or the authorized retailer/reseller. Upon purchase of a Product, refer to the Limited Hardware Warranty (if any) or other warranty document accompanying Your Product. You shall adhere strictly to the terms stated in the warranty document, although certain terms of this Limited Hardware Warranty Policy and the Warranty Return Policy found at Zii Support Web Page may also be applicable. In the event of contradiction, warranty holder should refer to Zii Contact Center for clarification. The terms of the warranty document accompanying the Product take precedence over any online policies. The warranty provider may update the terms of the Limited Hardware Warranty and we may update the policies from time-to-time without notice to You.
